1. Acceptance of Terms

By accessing the Pivot Auto Transports website, requesting a quote, or booking a shipment, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use this website or our services. These Terms apply to all visitors, users, and customers of Pivot Auto Transports LLC.

2. About Pivot Auto Transports

Pivot Auto Transports LLC ("Pivot," "we," "us," or "our") is a licensed vehicle transportation broker operating under FMCSA Broker License #82799198. We are not a motor carrier. We do not own or operate the trucks, trailers, or equipment used to physically transport vehicles. Instead, we arrange transportation on your behalf through a network of independently owned and operated, FMCSA-licensed carriers.

3. Description of Services

Pivot provides vehicle transport brokerage services, including but not limited to: obtaining shipping quotes, identifying and vetting qualified carriers, coordinating pickup and delivery logistics, and serving as a point of contact throughout the shipment process. Actual transportation of your vehicle is performed by a third-party carrier, not by Pivot directly.

4. Quotes, Booking & Pricing

Quotes provided through our website, by phone, or by email are estimates based on route, vehicle type, transport method, and current carrier market conditions at the time the quote is generated. Once a shipment is booked and confirmed in writing, the quoted rate is locked and will not increase due to standard market fluctuations, absent a material change in shipment details (such as vehicle type, dimensions, or pickup/delivery location) provided by the customer after booking.

A deposit may be required at the time of booking to secure carrier assignment. The remaining balance is due to the carrier at the time of delivery, as disclosed at booking.

5. Cancellation Policy

You may cancel a booked shipment at any time prior to carrier dispatch by contacting Pivot directly. Cancellation terms, including any applicable deposit refund or cancellation fee, will be disclosed at the time of booking and may vary depending on whether a carrier has already been assigned to your shipment. Once a carrier has been dispatched or has arrived for pickup, cancellation fees may apply as determined by the assigned carrier.

6. Carrier Selection & Broker Liability

Pivot selects carriers from its network based on internal vetting criteria, including verification of FMCSA operating authority, current cargo insurance, and inspection history. While we take carrier vetting seriously, Pivot does not guarantee the performance, timeliness, or conduct of any third-party carrier. The carrier assigned to your shipment is an independent contractor, not an employee or agent of Pivot Auto Transports.

Direct liability for damage, loss, or delay occurring during physical transport rests with the carrier and its cargo insurance policy, not with Pivot as broker. Pivot will assist customers in filing and pursuing claims with the responsible carrier's insurance, as outlined in Section 9.

7. Payment Terms

Accepted payment methods for deposits and final balances will be disclosed at booking. Final balances are typically payable directly to the carrier at delivery via cash or certified funds, unless otherwise agreed in writing. Pivot is not responsible for payment disputes arising from payment methods not authorized or disclosed at booking.

8. Vehicle Condition & Bill of Lading

At pickup and delivery, the carrier will complete a Bill of Lading ("BOL") documenting the vehicle's condition. The customer or their authorized representative is responsible for reviewing and verifying the accuracy of the BOL at both pickup and delivery before signing. Failure to note existing damage at pickup, or new damage at delivery, on the BOL prior to signing may materially affect the customer's ability to file a valid damage claim.

Customers are responsible for removing all personal property from the vehicle prior to pickup. Carriers are not licensed to transport personal property inside vehicles, and such property is not covered by cargo insurance.

9. Claims Process

Any damage discovered at delivery must be noted on the delivery BOL before signing and reported to Pivot within 24 hours of delivery. Pivot will assist the customer in submitting a claim to the responsible carrier's cargo insurance provider. Claims not properly documented on the BOL at the time of delivery may be difficult or impossible to substantiate and may be denied by the carrier's insurer.

10. Limitation of Liability

To the fullest extent permitted by law, Pivot Auto Transports' liability as a broker is limited to the brokerage services provided — namely, carrier sourcing, vetting, and shipment coordination. Pivot is not liable for damage, loss, delay, or any other outcome arising from the acts or omissions of a third-party carrier. In no event shall Pivot's total liability to any customer exceed the amount of brokerage fees actually paid to Pivot for the shipment in question.

Pivot makes no warranties, express or implied, regarding the services provided by third-party carriers, and disclaims any liability for indirect, incidental, or consequential damages arising from the use of our services or website.

11. SMS & Text Messaging Policy

By providing your mobile phone number to Pivot Auto Transports through our website, quote form, or in the course of booking a shipment, you consent to receive text messages (SMS) from Pivot related to your inquiry or shipment, as described below.

Quote confirmations and follow-up regarding a quote request

Booking confirmations and carrier assignment updates

Pickup and delivery scheduling and window confirmations

Shipment status updates, including delay notifications

Requests for information needed to complete your shipment

12. Website Use & Conduct

You agree not to use this website for any unlawful purpose, to submit false or misleading information in any quote or booking request, or to attempt to interfere with the proper functioning of the website. Pivot reserves the right to refuse service to anyone for any lawful reason, including suspected fraudulent or abusive use of our quote system.

13. Intellectual Property

All content on this website, including text, graphics, logos, and design elements, is the property of Pivot Auto Transports LLC and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

14. Privacy

Our collection and use of personal information, including phone numbers and contact details submitted through this website, is governed by our Privacy Policy. By using this website, you consent to the data practices described there.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of [State], without regard to its conflict of law provisions.
